Nick has practised exclusively in insurance litigation since his admission in 2001, primarily dealing with public liability and product liability claims acting on behalf of various insurers.
Nick is an experienced litigator and negotiator, specialising in the defence of public liability claims including large personal injury claims and complex insurance claims.
Nick works closely with insurers to provide advice in the defence of each claim, including targeted options for early dispute resolution.
Nick’s insured clients have included landlords, shopping centres, schools, builders, and public authorities
Nick has acted in matters before the District Court, Supreme Court, NCAT, and the Court of Appeal.
Experience
- Acting for a shopping centre involving significant injuries to a young child who fell from an escalator;
- Acting for the manufacture of tractor tyres who was sued after a Plaintiff sustained catastrophic injuries after a tyre exploded, which also dealt with complex indemnity issues involving limits of indemnity after CGU was sued directly in place of the deregistered insured;
- Acting for a school in a multi-party Supreme Court matter, after one its employees received extensive burns after a gas explosion, resulting in a relatively small apportionment of liability;
- Successfully acted in the Court of Appeal which upheld the dismissal of proceedings due to a statute of limitations defence involving a minor;
- Successfully acted for an Aged Care facility who was sued after a visitor tripped on an alleged hazard in the carpark, both in the District Court and subsequent Court of Appeal proceedings;
- Acting for developers, head contractors and sub-contractors, in defence of multiple worksite injury claims;
- Acting for owners of multiple shopping centres in relation to slip and fall claims;
- Acting for landlords/Strata Plans in multiple claims by tenants and their visitors;
- Acting for the supplier of an e-scooter after its battery pack caught fire causing significant damage to a Strata premises;
- Successfully negotiated a multi-party claim involving a Plaintiff who was badly injured when fell from a ladder at a worksite;
- Successfully convincing a claimant’s solicitor to persuade the claimant to drop his claim against a Club after the claimant was engaged in a fight with a security guard started by the claimant.
