Mitch is an experienced insurance and litigation lawyer who acts for insurers and private clients. His experience includes public and product liability, professional indemnity and coronial investigations.
Mitch has represented a national retailer as well as other occupiers in numerous personal injury claims. He is highly regarded in the profession by both his clients and peers and draws on practical experience. He also has an in-depth knowledge in the medical defence space and partners with his clients to navigate challenging situations. He is a trusted advisor to his clients.
Mitch has appeared on behalf of clients in the Magistrates, District and Supreme Courts in Queensland and well as the Supreme Court and Court of Appeal in New South Wales. He also has extensive experience in litigation in other States of Australia. Mitch regularly appears for health practitioners in disciplinary matters before QCAT, NCAT, National Boards as well as being instructed to act for interested parties in coronial investigations in Queensland and New South Wales.
Mitch is a member of the NSW Claims Discussion Group (Insurance) and QLD Claims Discussion Group.
- Defending personal injury matters for state government departments and large corporate clients, including assisting in overturning on appeal a slip and fall decision of the District Court of NSW.
- Acting for insurers in defence of liability claims including shopping centre slip and falls, daycare/childcare centres, sports and leisure activities, carpark injuries and injuries sustained at fairs and amusement centres.
- Acting for a construction company in defence of personal injury proceedings involving a member of the public injured while riding his bicycle along a roadway. Acted at first instance and also on appeal - Horne v J K Williams Contracting Pty Ltd [2023] NSWCA 58.
- Acting for insurers in relation to product liability claims (injury and property).
- Providing indemnity advice to insurers over a range of general liability policies.
- Defending claims for insurers operating in the domestic insurance market, including claims involving allegations of fraud and non-disclosure.
- Defending personal injury matters for insurer clients operating in the health industry including medical, pharmacy, dentistry, podiatry and other allied health professions.
- Appearing for health practitioners before disciplinary tribunals and boards across a number of Australian jurisdictions.
- Appearing for interested parties in coronial investigations in Queensland and New South Wales.
- Defending professional negligence claims on instructions from insurers for a variety of professionals including accountants, liquidators, lawyers, insurance brokers, engineers and various other professions.
- Investigating and defending income protection and similar claims on behalf of life insurers and superannuation fund trustees.
- Providing indemnity advice to insurers over a range of professional indemnity and general liability policies.
