
Emily has experience advising and acting in high-profile and complex matters across areas of employment law and industrial relations. She has advised on workplace matters including employment contracts, modern awards and enterprise agreements, anti-discrimination and diversity, sexual harassment, bullying, performance and conduct, industrial disputes, termination and redundancy, unfair dismissal and adverse action, confidential information protection, and post-employment restraints. Emily has worked closely with private sector clients (including international and ASX-listed corporations), public sector agencies, and not-for-profit organisations.
Experience
- Acted in various Fair Work Commission proceedings for NSW Government entities and a variety of ASX-listed corporations in unfair dismissal and general protections matters.
- Acted for a NSW Government entity in unfair dismissal proceedings involving out-of-work conduct before the Fair Work Commission, Full Bench of the Fair Work Commission, and the Full Federal Court.
- Acted for a NSW Government entity in discrimination proceedings on the grounds of race, sex, and carer’s responsibilities before the NSW Civil and Administrative Tribunal.
Acted for local council in discrimination proceedings before the Australian Human Rights Commission. - Acted for an international security systems company in contested general protections proceedings before the Federal Circuit and Family Court of Australia (Division 2).
- Advised a multinational company on matters pertaining to suspected widespread breaches of the Fair Work Act 2009 (Cth), including liability, penalties, and the remediation process.
- Advised clients on complex payroll compliance reviews in relation to suspected underpayments arising under modern awards and enterprise agreements.
- Provided strategic and drafting advice to a global technology company during its bargaining process for a new enterprise agreement.
- Provided strategic and drafting advice to a public sector energy during its bargaining for a new enterprise agreement.
- Advised on the restraint of trade and confidentiality obligations of former employees and acting for employers in matters of suspected breaches.
- Developed bespoke employment contracts and workplace policies for a variety of clients across the public and private sectors.
- Completed Modern Award coverage reviews for several ASX-listed companies.
- Completed desktop audits for several financial service companies regarding the Respect@Work reforms and Australian Human Rights Commission’s guidelines on the positive duty to eliminate workplace harassment.
