Managing poor performance or investigating misconduct – how to avoid bullying claims

Managing under-performing employees or dealing with misconduct issues can often be challenging. However, what happens if during the process the employee goes on stress leave and claims that they have been bullied or harassed? How should you deal with the complaint and what legal risks does the business face?
