Briefing on the Asia Region Funds Passport and the Corporate Collective Investment Vehicle (CCIV)

The Hall & Wilcox Financial services team invite you to a twilight seminar examining the Asia Region Funds Passport and the Corporate Collective Investment Vehicle (CCIV) regime from a corporations law and tax law perspective.

The Passport regime is a multilateral framework that will allow eligible funds to be marketed across economies participating in the Asia Region Funds Passport with limited additional regulatory requirements. The CCIV will be an Australian company with fund-like features that aims to be an internationally recognisable investment vehicle that can be readily marketed to foreign investors, including through the Asia Region Funds Passport.

The Passport legislation has been enacted, with details being developed. The CCIV regime is still being crafted, both in relation to the regulatory and tax settings. We will look at key elements relevant to Australian and global fund managers including:

  • The regulatory infrastructure of the Passport and the CCIV regime.
  • The key features of a CCIV.
  • Legal and practical issues associated with establishing and operating a CCIV.
  • Tax issues arising under the CCIV regime, including a comparison with the MIT regime and general investment trusts.
