Practices

Melissa is an experienced insurance lawyer who focuses on advising major national insurers on CTP and public liability claims ranging from homeowners to small businesses.

Melissa advises on a variety of aspects of CTP and liability claims, many of which involve complex liability and procedural issues and are litigated in the various Courts around Sydney. She also has experience in the Claims Assessment and Resolution Service, District and Supreme Courts and the Court of Appeal.

Melissa primarily acts for large national insurers specialising in CTP and liability insurance.

Melissa was recently a winner in the Lawyers Weekly’s 30 Under 30 Awards, highlighted for her experience within the insurance sector.

Experience

  • Advising and acting in a claim for the insurer of a mini bus driver sued pursuant to section 3A(1)(d) of the Motor Accidents Compensation Act 1999 (NSW). The matter involved complex questions of indemnity and ultimately, Melissa was able to successfully defend a verdict in favour of the driver in the NSW Court of Appeal.
  • Successfully defended a claim against the insurer of a homeowner in a claim made pursuant to section 25 of the Companions Animals Act 1998 (NSW) when the pet dog escaped and was involved in a road accident.
  • Advising in a claim for significant damages arising from a motor accident involving a stray animal on a rural roadway. The matter raised the ‘blameless accident’ provisions of the Motor Accidents Compensation Act 1999 (NSW) and the verdict was successfully maintained in the NSW Court of Appeal.
